LONGEVITY ARCHITECTS TERMS OF SERVICE


Effective Date: 18 May 2025

Welcome to Longevity Architects, LLC ("Longevity Architects," "we," "us," or "our"). These Terms of Service ("Agreement") govern your access to and use of our website and all coaching programs, functional diagnostic services, and related offerings (collectively, the "Services"). By accessing our website or purchasing, enrolling in, or participating in any of our Services, you ("Client") agree to be bound by this Agreement.

 

 

1. WEBSITE TERMS OF USE

1.1 Acceptance of Terms
By accessing or using the Longevity Architects website (the "Site"), you agree to comply with and be bound by these Website Terms of Use, this Agreement, and our Privacy Policy. If you do not agree, you may not use the Site.

1.2 Intellectual Property
All content on this Site, including but not limited to text, images, graphics, design, logos, videos, and software, is the property of Longevity Architects or its licensors, and is protected by intellectual property laws. You may not copy, reproduce, distribute, republish, download, or display any content without prior written permission.

1.3 Acceptable Use
You agree not to:

  • Use the Site in any unlawful manner or for any unlawful purpose.

  • Post or transmit any content that is harmful, defamatory, obscene, abusive, or invasive.

  • Attempt to interfere with the Site’s operation or security.

  • Use the Site to distribute unsolicited promotional or commercial content (spam).

1.4 Third-Party Links
This Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any linked sites. Your use of third-party sites is at your own risk.

1.5 Privacy Policy
Please refer to our Privacy Policy to understand how we collect, use, and protect your personal information.

1.6 No Warranty
The Site is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind regarding the accuracy or reliability of any content on the Site.

1.7 Limitation of Liability
To the fullest extent permitted by law, Longevity Architects disclaims liability for any damages arising from your use of or inability to use the Site.

2. PROGRAM OVERVIEW

 

2.1 Program Offerings
We offer a variety of wellness and coaching Programs, which may include:

  • Individual health assessment and coaching sessions

  • Functional lab assessments

  • Group coaching and education

  • Optional services (e.g., CGMs, supplement guidance)

 

2.2 Customization & Pricing
The specific details of each Program, including its scope, duration, structure, and pricing, will be provided during checkout. All prices are subject to change. You will be informed of any applicable fees prior to purchase. All sales are final.

 

2.3 Optional Add-Ons
Certain Programs may include optional add-ons for additional fees. These may include lab upgrades, continuous glucose monitors, extended sessions, or additional practitioner guidance.

 

2.4 Client Portal (Biocanic)
Our Programs are supported through Biocanic, a third-party platform for health data, scheduling, and communication. Clients must activate and use their Biocanic account as part of their participation in any Program.

3. FUNCTIONAL DIAGNOSTIC NUTRITION (FDN) TERMS

 

Programs that include lab testing, wellness evaluations, or any use of functional diagnostic data are subject to additional terms. These services are educational in nature and are not intended to diagnose, treat, or cure any condition.

By enrolling in a Program that includes lab analysis or FDN services, you acknowledge and accept the FDN Terms of Service outlined in Section 16 of this Agreement.

4. EXPECTATION & RESPONSIBILITIES

 

Participation in any Program is a collaborative effort. To get the most out of your experience, you are expected to engage fully and take ownership of your health journey.

What You Can Expect from Your Coach:
• Your coach will come prepared to each session
• Your coach will devote my full attention to you during our time together
• Your coach will provide education on cognitive, metabolic, immune, thyroid, digestive, and cardiovascular health within my scope of practice
• Your coach will serve as your mentor and advocate
• Your coach will challenge you to grow outside your comfort zone, when appropriate
• Your coach will offer support, encouragement, and personalized guidance
• Your coach will create a supportive and distraction-free environment
• Your coach will coordinate with your care team if requested
• When appropriate, your coach will refer you to a licensed healthcare professional

What Your Coach Will Not Do:
• Your coach will not diagnose any disease or illness
• Your coach will not prescribe treatments for any disease or illness

What We Expect from You:
• Show up on time and without distractions
• Engage with kindness, respect, and effort
• Be prepared to give your best efforts to the Program
• Complete any recommended action steps between sessions
• Set realistic expectations and goals
• Take responsibility for progress between sessions
• Be open to new ideas and growth
• Provide feedback about your progress and where you need more support
• Take responsibility for your own health decisions

5. COMMUNICATION & SCHEDULING

 

You may contact your coach between scheduled sessions for brief questions or updates. Communication is available via email, phone, or text during regular business hours (8:00 AM – 5:00 PM Central Time). While we strive to respond as promptly as possible, please allow up to one business day for a reply on weekdays, and slightly longer on weekends or holidays. If your question requires deeper discussion, it will be addressed during your next scheduled session.

 

 

6. PAYMENT TERMS & POLICIES

 

6.1 Payment Authorization
By purchasing a Program, you authorize us to charge your selected payment method. We accept credit card, ACH, and other approved payment forms. Credit card payments may incur a processing fee.

 

6.2 Recurring Payments
If a Program involves payment installments, you agree to complete all payments on the selected schedule.

 

6.3 Payment Failure
Failure to maintain valid payment may result in suspension of service and access.

 

6.4 Refund Policy
All sales are final and non-refundable. This includes, but is not limited to:

  • Non-use of sessions or services

  • Scheduling delays

  • Client dissatisfaction

  • Voluntary early termination

 

In exceptional cases, Longevity Architects may, at its discretion, offer service credit. This does not constitute a waiver of the no-refund policy.

7. SCHEDULING & CANCELLATION POLICY

7.1 Scheduling Requirements
You are responsible for scheduling your sessions using the instructions provided at the start of your Program. Sessions should be scheduled promptly upon enrollment. Failure to schedule within the defined Program timeline may result in forfeited sessions.

 

7.2 Rescheduling & Missed Sessions
If you need to cancel or reschedule a session, please provide at least 24 hours’ notice. Sessions missed without adequate notice may be forfeited and not eligible for rescheduling.

 

7.3 Expiration
All sessions must be used within the defined Program period. Expired sessions will not be refunded or rescheduled unless otherwise agreed in writing.

8. DISCLAIMERS & LIMITATIONS

8.1 No Medical Advice
Our Programs are educational and are not a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of a qualified healthcare provider with any questions you have regarding a medical condition.

 

8.2 No Guarantee of Results
Results vary by individual. We do not guarantee any specific outcome or result from your participation in any Program or service.

 

8.3 Limitation of Liability
To the fullest extent permitted by law, Longevity Architects and its affiliates disclaim all liability for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in our Programs, Services, or use of our website or platform. This includes, but is not limited to:
• Reliance on educational content or coaching guidance
• Use or misuse of supplemental tools, advice, or recommendations
• Delays, errors, or omissions in scheduling, communications, or service delivery
• Loss of data, income, business opportunities, or goodwill

 

You acknowledge and agree that your participation is voluntary and that you assume full responsibility for your health choices and outcomes.

Note: Additional disclaimers and limitations apply to Programs involving Functional Diagnostic Nutrition (FDN) services. Please refer to Section 17: FDN Terms of Service for those terms.

9. CONFIDENTIALITY

 

9.1 One-on-One Sessions
All information shared during individual coaching sessions will remain confidential. Information will only be disclosed under the following conditions:
• It is necessary for the performance of services by Longevity Architects team members or contractors;
• Disclosure is required by law;
• It is necessary to prevent harm to the health, safety, rights, or property of any individual;
• You provide prior written permission.

 

9.2 Group Sessions
When participating in group settings—including but not limited to group coaching sessions, forums, retreats, or online communities—you acknowledge that information you share may be visible to or used by others. Longevity Architects is not responsible for any unauthorized use or disclosure of information shared in these settings.

9.3 HIPAA Disclaimer
Longevity Architects is not a HIPAA-covered entity. While we take reasonable measures to protect your information, federal HIPAA protections do not apply to our Programs or services.

10. INTELLECTUAL PROPERTY

All materials provided by Longevity Architects are the sole property of Longevity Architects. The Client may not copy, distribute, or share any content without prior written permission. Materials are provided with a single-user license for individual use only and may not be used commercially without written authorization.

11. ASSUMPTION OF RISK & RELEASE

11.1 Personal Responsibility
You acknowledge that your participation in the Program is voluntary and that you are solely responsible for your choices, actions, and results. You agree to act with care and respect toward yourself and others throughout the Program.

 

11.2 Health and Wellness Limitations
Longevity Architects does not provide medical advice, diagnosis, or treatment. You are advised to consult a licensed healthcare provider before making any changes to your health regimen or medical care.

 

11.3 Reliance on Information
You affirm that all information you provide regarding your health, allergies, and treatments is complete and accurate to the best of your knowledge. Longevity Architects is not responsible for adverse outcomes based on incomplete or inaccurate information you provide.

 

11.4 Release of Claims
You agree to release, indemnify, and hold harmless Longevity Architects and its team members from any and all claims, liabilities, damages, or expenses arising from your participation in the Program, including but not limited to physical, emotional, or financial outcomes.

12. TERMINATION

 

12.1 Termination by Either Party
You may end your participation in a Program at any time by providing thirty (30) days’ written notice. Longevity Architects may also end your participation with thirty (30) days’ notice if we determine the Program is no longer a good fit.

 

12.2 Payment Obligations
All fees for your Program remain due and payable in full, regardless of when notice is given. We do not offer refunds or prorated credits for early termination. Any outstanding balances must be paid before the end of the notice period.

 

12.3 Terms That Survive Termination
Sections related to payments, confidentiality, and intellectual property will remain in effect even after your Program ends.

13. FORCE MAJEURE

Neither party shall be liable for failure or delay due to events beyond their control, including acts of God, pandemics, government restrictions, natural disasters, and other uncontrollable circumstances.

14. GOVERNING LAW & DISPUTES

 

We hope to resolve any concerns quickly and respectfully. If a dispute arises between you and Longevity Architects related to these Terms or your participation in a Program, both parties agree to:

 

14.1 Good Faith Resolution
First, attempt to resolve the issue through honest and respectful communication.

 

14.2 Mediation
If the issue cannot be resolved within thirty (30) days, both parties agree to engage in confidential mediation—either virtually or in the State of Texas—using a mutually agreed-upon mediator. Mediation costs will be shared equally.

 

14.3 Binding Arbitration
If mediation does not resolve the matter within sixty (60) days, the dispute will be submitted to binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Texas, and the arbitrator’s decision will be final and enforceable, with limited court review.

 

14.4 Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

 

15. NON-SOLICITATION

 

You agree not to solicit, hire, or engage—directly or indirectly—any Longevity Architects team member, contractor, or facilitator for separate services outside the scope of your Program during the Program and for a period of twelve (12) months following its completion, without prior written consent.

Additionally, you agree not to solicit other clients or participants of Longevity Architects Programs for unrelated business opportunities, services, or offerings.

This clause is designed to protect the integrity of our Programs, community, and team relationships.

 

16. GENERAL TERMS

16.1 Notice
All formal communications required under these Terms, including cancellation or termination notices, must be sent to the email addresses below. You are responsible for keeping your contact and billing information current and must notify us of any changes within three (3) days.

16.2 Non-Disparagement
You agree not to make false, negative, or disparaging remarks about Longevity Architects, its team, or services—publicly or privately, including on social media. This does not limit your ability to share experiences when required by law or during a formal dispute resolution process.

 

16.3 Entire Agreement
These Terms, along with Appendix A: FDN Terms of Service (if applicable), and any Program-specific materials provided during registration, constitute the entire agreement between you and Longevity Architects. They supersede any prior verbal or written agreements related to your participation.

16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

16.5 Amendments
We may update these Terms from time to time. Continued use of our services indicates your acceptance of any updated terms. Any custom amendments must be agreed to in writing by both parties.

16.6 Survivability
Sections related to payment obligations, confidentiality, intellectual property, non-solicitation, indemnification, dispute resolution, and any provisions that by their nature should survive will remain in effect after your participation ends.

17. FUNCTIONAL DIAGNOSTIC NUTRITION (FDN) TERMS OF SERVICE

It is common practice for naturopaths, nutritionists, and other non-licensed practitioners to collect your agreement to the following terms. By enrolling in a Program that includes lab analysis or FDN services, you acknowledge and accept that we: 

  • are not medically qualified and do not provide any medical diagnosis or advice regarding any specific health condition

  • are not a substitute for advice from a qualified doctor and can provide education only on general principles of health building

  • recommend that you consult your doctor before making any changes to your diet or exercise regime or taking any dietary supplement

  • do not warrant the accuracy of any information provided as we are not the originators of the information

  • are not liable for any losses you may suffer by relying on any advice we provide

  • do not recommend any particular product or service

  • do not guarantee any positive results as we have no control over those results

  • are not a covered entity or a business associate of a covered entity under HIPAA

  • are unable to provide any diagnosis or CPT codes for insurance billing purposes

 

What We Do and Do Not Do

 

We may obtain a set of laboratory test results on your behalf from a Certified Laboratory in the United States and provide you with a holistic or nutritional interpretation of those test results that you can use exclusively as an educational tool for personal health purposes.

 

Your doctor may use the same test reports to diagnose and treat diseases or specific conditions, but we do not do this. The information we provide is not intended to, cannot, and should not be a substitute for a personal consultation with your qualified doctor. We do not accept any liability for any failure to identify any medical condition or disease, as this is not the purpose of our services.

 

We may provide you with information about products that we believe might benefit you, but such information is not to be taken as an endorsement or recommendation. Some products may require a prescription, but we do not dispense or prescribe any prescription products. The information provided is intended for educational purposes only and should not be taken as professional medical advice or used as a substitute for medical care. We are not responsible for any adverse effects or consequences that may result, either directly or indirectly, from that information.

We will make a reasonable effort to protect the privacy of your medical information that is shared with us, including any lab test results. However, that information is not covered by doctor-patient confidentiality, nor is it governed by HIPAA.

 

Consult Your Doctor 

 

We are not licensed medical advisors and make no claims to be so. The information we provide should not be taken to be and is not a substitute for personal medical advice and instruction. You should not take any action based solely on our advice or guidance.

 

You should consult your doctor: 

  • for any medical interpretation of your lab test results

  • on any matter relating to your health and well-being

  • before making any changes to your exercise routine or diet

  • before taking any nutritional, herbal, homeopathic, or hormonal supplementation

  • before beginning any therapy or modality

 

Exclusion of Warranties

 

We will provide our services to you with reasonable care and skill. But we make no other warranty, express or implied, with respect to those services. All other warranties are excluded to the maximum extent permitted by law.

 

We make no warranty as to the accuracy of the laboratory test results we receive.

We make no warranty, expressed or implied, about the quality or effectiveness of any interpretation, apparatus, advice, treatment, or product.  In no event will we be liable for any physical or mental injury or any adverse side effects that may arise from the use of any such interpretation, apparatus, advice, treatment, or product.

 

We believe that the information we provide, including that on our websites, videos, postings, brochures, emails, flyers, and information packets, is accurate, but we cannot guarantee such accuracy.  We, therefore, make no warranty as to the accuracy of that information, and it should not be relied upon as being correct, complete, or accurate. It is your responsibility to verify such matters independently from primary sources of information and by taking specific professional advice.

 

Exclusion of Liability

 

If you rely on, buy, or use a product or therapy or modality, you do so at your own risk. We do not guarantee any results as we have no control over those results. Each person is different, and the way someone reacts to a product or therapy may be significantly different from another. We cannot predict how you may respond to any particular product or therapy.

 

To the maximum extent permitted by law, we exclude:

  • any and all liability in contract, tort (including negligence), breach of statutory duty or otherwise for any direct, indirect, special, incidental, or consequential costs, losses, claims, damages, expenses or proceedings (including but not limited to loss of profits and wasted management time) incurred or suffered by you arising directly or indirectly out of or in connection with our services, including but not limited to any loss, damage or expense arising from any defect, error, imperfection, fault, mistake or inaccuracy with the information, education or advice we provide;

  • any and all liability for injury or loss arising out of the use of, or reliance on, the laboratory results and/or the dietary, supplement, and lifestyle suggestions we may provide;

  • any and all liability for injury or loss arising from any product or treatment you may choose to take

  • any and all liability for any failure to identify any medical condition or disease. You understand and agree that this is not the purpose of our services.

 

This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages or injury, loss of data, income or profit, loss of or property damage, and claims of third parties.

No recommendation 

 

All material and information we may provide about products and therapies are provided solely for educational purposes and for use when discussing your health with your doctor. By providing you with such material and information, we do not necessarily endorse, recommend or promote any such product or therapy.
